The Supreme Court of the State of New York and New York Family Court have jurisdiction to determine custody of the child during divorce or other Court involvement, until the child attains the age of 18. The Court retains jurisdiction in matters of Child Support until the child attains the age of 21. It is the job of the Court to decide where the best interest of the child is served. The parent not awarded custody is the payor spouse and is required to pay Child Support until the child attains the age of 21. Child Support can increase based on certain factors including Cost of Living Adjustments (COLA). COLA adjustments are generally not influenced by the income of the Payor.
